The Employees Pension Scheme 1995 Benefits of leaving service and disablement

The Employees Pension Scheme 1995Benefits on leaving service before being eligible for monthly members pension.

(A) If a member has not rendered the eligible service prescribed in paragraph 27[9] on the date of exit, or on attaining 58 years of age whichever is earlier, he/she shall be entitled to a withdrawal benefit as laid down in Table 'D' or may opt to receive the scheme certificate provided on the date he/she has not attained the 58 years of age: 27. Subs. by G.S.R. 134, dated the 28th February, 1996 (w.e.f 16th March 1996).
Provided that an existing member shall receive additional return of contributions for his/her past service under the Employees' Family Pension Scheme, 1971 computed as withdrawal-cum retirement benefits as per Table 'A' multiplied by the factor given in Table 'B'.

The Employees Pension Scheme 1995 Benefits on permanent and total disablement during the service:

(A ) A member, who is permanently and totally disabled during the employment shall be entitled to pension as admissible under sub-paragraph (2) to (5) of paragraph 12 as the case may be subject to a minimum of Rs. 250/- per month notwithstanding the fact that he/she has not rendered the pensionable service entitling him/her to pension under paragraph 12 provided that she/he has made at least one month's contribution to the Pension Fund.
(AA ) The monthly member's pension in such cases shall be payable from the date following the date of permanent total disablement and shall be tenable for the life-time of the member.
(BB) A member applying for benefits under this paragraph shall be required to undergo such medical examination as may be prescribed by the Central Board to determine whether or not he or she is permanently and totally unfit for the employment which he or she was doing at the time of such disablement.

Definition of PF scheme EDLI-1976 :-

In this scheme, unless the context otherwise requires
a) ACT means the Emploees Provident funds and miscellaneous provision act,1952
b) Assurance benefit means a payment linked to the average balance in the provident fund account of an employee payable to a person belonging to his family or otherwise entitled to it in the event of death of the employee while being a member of the fund.
c) All other words and expressions used herein but not defined shall the meaning respectively assigned to them in the act or Employees provident funds scheme 1952. this scheme shall be administrated by the central board constituted under section 5A of the Act.
d) The provisions of theis scheme shall com into force on the 1 day of August 1976.


PF - Epfo Employees Deposit Linked Insurance Schemes Benefits are according to the revised plan, the maximum benefit under the scheme Rs 1,30,000 contribution can be paid upto the maximum limit of wages under this scheme Rs.6500. Family get twenty times of the average salary of the last 12 months of member. This benefit given only incase of death of an employee who is member of the scheme at the time of the death.

PF - Epfo Employees Deposit Linked Insurance Schemes Nominations under the EPF scheme will be applicable for the EDLI scheme also.


Mode of payment of contribution :-The contribution by the employer shall be remitted by him together with administrative charges at such rate as the Central Government may fix from time to time under sub-section 4 of Section 6C of the Act, to the Insurance Fund within fifteen days of the close of every month by a separate bank draft or cheque or by remittance in cash in such manner as may be specified in this behalf by the Commissioner. The cost of remittance if any, shall be borne by the employer.

PF Scheme 1952 Benefits are Accumulation plus interest upon retirement , resignation,death. Partial withdrawals allowed for specific expenses such as houjse construction,higher studies,marriage,illness etc...

PF Scheme 1952 Nomination : There is a common form for all the three schemes Form 2 (R) the nominations in case of EPF Scheme are also applicable for the EDLI scheme. Member not having any family member as defined in the said para can nominate any other person bu the nomination will become invalid in case of the member acquiring family. And third is Member having family can nominate any one or more of the family members as defined under the para 2 (F) of the EPF Scheme 1952.

Membership of the Fund

Classes of employees entitled and required to join the fund.....

1. a) Every employee employed in or in connection with the work of a factory or other establishment to which this scheme applies other than an excluded employee,shall be entitled and required to become a member of the fund from the day this paragraph comes into force in such factory or other establishment.

Every employee employed in or in connection with the work for factory or other establishment to which this scheme applies, other than an excluded employee , shall also be entitled and required to become a member of thefund from the day this paragraph comes in to force in such factory or establishment.

Contributions....

The contributions payable by the employer under the scheme shall be at the rate of ( ten per cent) of the ( basic wages, dearness allowance ( including the cash value of any food concession ) and retaining allowance payable to each employee to whom the scheme applies : provided that the above rate of contribution shall be twelve per cent in respect of any establishment of class of establishments which the central government may specify in the official gazette from time to time under the first proviso to sub section of section 6 of the Act.
